HDB Rental Deposit Dispute: What Tenants Can Do

Deposit disputes are usually contractual disputes. Keep the tenancy agreement, payment records, condition photos, messages and move-out evidence. Depending on the facts and claim, mediation, the Small Claims Tribunals or legal action may be possible.

Protect your evidence

  • Keep the signed tenancy agreement.
  • Keep bank transfers, receipts and deposit acknowledgements.
  • Photograph the room and common areas at move-in and move-out.
  • Keep written notice of termination and key-return records.
  • Ask for an itemised explanation of any deposit deduction.

Possible dispute routes

The Council for Estate Agencies notes that disputes not involving a property agency or property agent may need to be handled through mediation, the Small Claims Tribunals or legal action.

The State Courts state that the Small Claims Tribunals can hear eligible disputes involving residential tenancy agreements not exceeding 2 years, subject to the tribunal’s jurisdiction and claim limits.
